What if I Bear Some Responsibility for the Burn Injury?

You can still collect compensation if you were partly responsible for your injuries. New York uses a pure comparative negligence standard in personal injury cases. The percentage of responsibility you hold for your burn injuries reduces your damages by that percentage.

You must file your burn injury lawsuit within three years of your accident date. If your burns resulted from an accident on government property, you must file a claim with the city within 90 days of your accident. If you are filing a wrongful death claim, you have two years from the date of death.

The deceased’s personal representative can file a wrongful death suit in New York. The state’s distribution of estates law primarily determines who receives compensation. Spouses and children collect first. If there is no spouse or children, parents collect. Parents also collect if there is a spouse but no children. Siblings and grandparents can collect damages if none of those parties exist.
