Economic vs. Non-Economic Damages
Economic damages are compensation for monetary losses, such as past and future lost wages, past and future medical expenses, and property damage. By contrast, non-economic damages compensate for intangible losses, including:

New York’s Fault Laws
New York is a no-fault insurance state, which means drivers in the state must purchase personal injury protection (PIP) insurance. After a New York car accident, you must first seek compensation through your PIP policy, regardless of who was at fault for the accident.
PIP covers necessary medical expenses and up to 80 percent of lost wages (maximum of $2,000 monthly for up to three years). It also covers incidental expenses, such as housekeeping and transportation to medical appointments, for up to a year. If your loved one was killed in a car accident, PIP also provides certain death benefits payable to the estate of the decedent.
Importantly, no-fault PIP insurance does not cover non-economic damages. To recover non-economic damages after a car accident, you must file a lawsuit against the at-fault driver or a liable third party. In New York, you can step out of the no-fault system if you suffer either (1) a “serious injury” or (2) a “basic economic loss” exceeding $50,000.
Severity of Injuries
The NYPD Traffic Safety Forum reports that 3,090 collisions happened in the Bronx in 2023, which injured 1,186 people and killed 10. Section 5104 of the New York Insurance Code allows you to file a claim against the at-fault driver’s insurance policy if suffer a “serious injury,” defined as:
- Death
- Dismemberment
- Significant disfigurement
- A broken bone
- Miscarriage
- Permanent organ damage
- Permanent loss or significant limitation of a bodily function
- An injury that prevents you from performing usual activities for 90 days or more
If you suffer a serious injury, you can then file a claim against the at-fault driver’s auto liability policy, as well as a personal injury lawsuit. New York drivers are required to carry the following minimum auto liability coverage:
- $10,000 for property damage for a single accident
- $25,000 for bodily injury per person involved in an accident ($50,000 if they are killed)
- $50,000 for bodily injury for two or more people in an accident ($100,000 if they are killed)

How Long Do I Have to File an Injury Claim After an Accident in the Bronx?
The New York personal injury statute of limitations generally gives three years from the date of an accident to file a personal injury lawsuit. However, if your loved one was killed in a car accident, their estate representative normally has two years from the date of death to file a wrongful death claim.
