A work related accident has a lot of things to consider. In personal injury, typically speaking, workers compensation cases, which means somebody’s injured in the capacity of their job, is barred from suing their employer. But that doesn’t mean that they don’t have a 3rd party action. 3rd party action means even though they’re acting within the capacity of their job duties, they can still sue some other person for interfering with that. So in those situations, yes, absolutely, you know, you can still sue in a third party capacity through personal injury. And you’re not limited to the recoveries that workers compensation permit. In personal injury, you’re able to cover a lot more, typically speaking, than in workers comp where you’re very confined.
